SMS Terms & Messaging Policy
Last Updated: August 19, 2026
These SMS Terms & Messaging Policy ("SMS Terms") explain how Smithco Management ("Smithco Management," "we," "us," or "our") uses SMS and text messaging and the requirements that apply when you receive or send text messages through our services.
By providing a mobile telephone number to Smithco Management and opting in to receive text messages, you consent to receive SMS messages from Smithco Management in accordance with these SMS Terms and applicable law.
1. SMS Messaging Services
Smithco Management may use SMS and text messaging to communicate with customers, prospective customers, and users of our services.
Depending on the service involved, messages may include:
2. Consent to Receive Messages
By voluntarily providing your mobile telephone number and affirmatively opting in to receive SMS messages, you authorize Smithco Management to send text messages to that number for the purposes described at the time of consent.
Consent is not required as a condition of purchasing goods or services unless specifically stated otherwise.
Where required by law, marketing messages will only be sent after obtaining the appropriate level of consent.
Your consent applies to the telephone number you provide. You are responsible for ensuring that you provide a telephone number that you own or are authorized to use.
3. Message Frequency
Message frequency varies depending on your interactions with us, the services you use, and the communication preferences you select.
You may receive multiple messages during a given period when necessary to provide requested services, reminders, customer communications, or other communications for which you have provided consent.
We do not guarantee a particular message frequency.
4. Message and Data Rates
Message and data rates may apply to SMS messages depending on your wireless carrier and mobile service plan.
Smithco Management does not control or charge these carrier fees.
You are responsible for any charges imposed by your wireless carrier.
5. How to Opt Out
You may opt out of receiving SMS messages at any time by replying:
STOP
to the number from which you are receiving messages.
After you send STOP, we may send a single confirmation message acknowledging your request, where permitted by applicable requirements. You should then no longer receive marketing SMS messages from that messaging program.
You may also contact us at tyler@smithcomgmt.net to request that your number be removed from marketing communications.
Opting out of marketing messages does not necessarily prevent you from receiving strictly necessary transactional or service-related communications where those communications are permitted without marketing consent.
6. Getting Help
For assistance with SMS messaging, reply:
HELP
to the number from which you received the message.
You may also contact:

7. Re-Subscription
If you have previously opted out of marketing SMS messages and later wish to receive them again, you may provide new consent through an available Smithco Management opt-in method.
Your new consent must be provided through an applicable opt-in process.
8. Privacy
We collect and process information associated with SMS communications in accordance with our Privacy Policy.
This may include:
We may use third-party technology providers to facilitate SMS communications, including telecommunications and messaging providers.
Our Privacy Policy is available through smithcomgmt.net.
9. Client Use of SMS Services
Smithco Management may provide SMS functionality to businesses that use our services.
If you are a Smithco Management client using SMS functionality to communicate with your own customers or contacts, you are responsible for your use of that functionality.
You agree to:
Smithco Management provides technology and services to facilitate communications but does not determine whether a particular client campaign satisfies the laws applicable to that client's business.
10. Prohibited Messaging
You may not use Smithco Management's SMS services to send:
Smithco Management may immediately suspend or terminate messaging functionality when we reasonably believe it is being abused or used in violation of these SMS Terms, applicable law, carrier requirements, or platform rules.
11. Consent Records
Where applicable, Smithco Management and its clients may maintain records relating to SMS consent, including:
These records may be retained as reasonably necessary to demonstrate compliance, administer services, resolve disputes, and satisfy legal or regulatory requirements.
12. Shared or Reassigned Telephone Numbers
You agree not to provide a telephone number for SMS communications unless you are authorized to use that number.
If you stop controlling a telephone number or transfer it to another person, you should notify Smithco Management so that the number can be removed from applicable communications.
Smithco Management may use commercially reasonable procedures to identify and suppress numbers that appear to have become invalid, reassigned, or otherwise unsuitable for messaging.
13. Delivery of Messages
SMS delivery depends on telecommunications carriers, networks, devices, geographic location, and third-party messaging infrastructure.
Smithco Management does not guarantee that every message will be delivered, delivered immediately, or displayed in exactly the same format on every device.
Messages may be delayed, blocked, filtered, or otherwise affected by carrier or network conditions.
14. Third-Party Messaging Providers
Smithco Management may use third-party providers to transmit SMS messages.
These providers may process telephone numbers, message content, delivery information, consent records, and other information necessary to provide messaging functionality.
Third-party providers may impose additional requirements or restrictions on SMS messaging.
Smithco Management may modify or replace messaging providers as reasonably necessary to operate our services.
15. Marketing Consent
Where SMS messages constitute marketing or promotional communications, Smithco Management will seek the consent required by applicable law before sending those messages.
Providing consent to receive marketing text messages does not require you to purchase anything from Smithco Management.
You may withdraw marketing consent at any time by replying STOP or contacting us directly.
16. Transactional and Service Communications
Certain messages may be sent because they are necessary to provide a service you requested or to manage your account.
Examples may include:
Opting out of marketing SMS does not necessarily prevent us from sending communications that are necessary to provide services or respond to a request, where such communications are permitted by law.
17. No Guarantee of Messaging Availability
SMS services may be temporarily unavailable due to:
Smithco Management does not guarantee uninterrupted SMS availability.
18. Changes to These SMS Terms
We may update these SMS Terms from time to time.
When we make changes, we will update the "Last Updated" date at the top of this page.
Continued use of our SMS services after an updated version becomes effective constitutes acceptance of the revised terms to the extent permitted by law.
